Processing of personal data, information clause (GDPR)

In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ EU L No. 119, p. 1), hereinafter referred to as the “GDPR”, informs that:

  1. The Controller of your personal data is MG Construction Sp. z o.o. with its registered office at ul. Okrężna 9, 87- 305 Zbiczno, Poland; phone: +48 797 951 606, e-mail: biuro@mg-construction.com.pl.
  2. Your personal data will be processed by the Controller for the purpose of handling enquiries, orders and invoicing resulting from the contracts concluded and consents granted.
  3. Your personal data will be processed on the basis of the provisions of the GDPR
    1. Art. 6(1)(a) of the expressed consent to data processing;
    2. Art. 6(1)(b) of the performance of contracts concluded between the Controller and entities performing tasks for the Controller;
    3. art. 6(1)(c) processing is necessary for compliance with a legal obligation incumbent on the Controller.
  4. In relation to the processing of your data for the purpose set out in point 3, the recipients of your data may be:
    1. public authorities and entities performing public tasks acting on the basis of legal provisions;
    2. entities with which the Controller has signed the relevant data processing entrustment agreements.
  5. Your personal data will be stored for the period necessary to fulfil the specified purposes contained in point 3, and thereafter in accordance with the period and to the extent required by generally applicable law.
  6. In relation to the processing of your personal data, you have the following rights:
    1. the right to access personal data, including the right to obtain a copy of such data,
    2. the right to request the rectification (amendment) of personal data;
    3. the right to request the erasure of personal data (right to be forgotten),
    4. the right to restriction of processing,
    5. the right to data portability and updating;
    6. the right to object to processing.
  7. Where the processing of your personal data is based on a person's consent to the processing of personal data (Article 6(1)(a) of the GDPR), you have the right to withdraw this consent at any time. Such withdrawal shall not affect the compatibility of the processing undertaken on the basis of consent before its withdrawal.
  8. In the event that you become aware of unlawful processing of your personal data, you have the right to lodge a complaint with the supervisory authority competent in matters of personal data protection – the President of the Office for Personal Data Protection.
  9. In the event that personal data are processed on the basis of a consent of the data subject, the provision of your personal data to the Controller is voluntary.
  10. The provision of your personal data is mandatory when the basis for personal data processing is a provision of law or a contract between the parties.
  11. Your personal data will not be processed in an automated manner and will not be profiled, data will not be transferred to third countries and international organisations, if such activities occur you will be informed.
